Dirt Drive reserves all rights to modify and/or cancel the services without prior intimation ensuring safety of participants due to external factors and/or unsafe weather conditions.
1. Introduction
1.1 Welcome to Dirt Drive (“Company,” “we,” “our,” or “us”). These Terms and Conditions (“Terms”) govern your use of our services. By booking or participating in our services, you agree to these Terms.
2. Booking and Payment
2.1 Booking: All booking must be made in advance through our website, by phone, or as agreed.
2.2 Payment: Payment is due at the time of booking unless otherwise agreed. We accept multiple payment options. Please refer to the booking section for details.
2.3 Cancellation Policy:
- Cancellations made 7 days prior to the scheduled service will incur a fee of A$50 per booking.
- Cancellations made within 7 days of the scheduled service and no-shows will not be refunded unless cancelled by the us.
- We hold all rights to cancel the service, if the participants are found under the influence of alcohol and/or any drug and no refunds will be provided.
3. Safety and Conduct
3.1 Safety Briefing: All participants must attend a safety briefing before commencing the off-roading activity.
3.2 Equipment: Participants must use the provided safety equipment, including seat belts, and any other required gear.
3.3 Health and Fitness: You must be in good health and physically fit to participate. If you have any medical conditions or concerns, please consult your physician before participating.
3.4 Behaviour: Participants must follow all instructions provided by our staff. Any behaviour deemed unsafe or disruptive will result in immediate termination of the activity without a refund.
4. Liability and Insurance
4.1 Assumption of Risk: Off-roading involves inherent risks including but not limited to, accidents, injury, or death due to vehicle operation, terrain conditions, equipment failure, and the actions of other participants. By participating, you acknowledge and accept these risks.
4.2 Liability Waiver: In consideration of your participation, you hereby release and hold harmless Dirt Drive, its owners, employees, agents, and affiliates from any and all claims, demands, or causes of action that may arise from your participation in off-roading activities, whether caused by the negligence of the Company or otherwise.
You agree to indemnify and hold harmless Dirt Drive from any claims, damages, or expenses arising from your participation in these activities.

5. Vehicle Use and Damage
5.1 Vehicle Operation: Only authorized personnel are allowed to operate our vehicles. Participants must ride as passengers and follow all instructions provided.
5.2 Damage: Participants are responsible for any damage to vehicles or equipment caused by their negligence or misuse. Charges for repairs or replacement will be billed to the participant.
6. Weather and Environmental Conditions
6.1 Weather Conditions: Off-roading activities may be affected by weather conditions. We reserve the right to cancel or reschedule services due to unsafe conditions.
6.2 Environmental Respect: Participants must respect the environment and follow all local regulations and guidelines related to off-roading.
7. Intellectual Property
7.1 Use of Materials: Any photos, videos, or other materials provided by us are for personal use only. You may not use them for commercial purposes without our written consent.
8. Changes to Terms
8.1 Amendments: We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting on our website.
9. Governing Law
9.1 Jurisdiction: These Terms are governed by the laws of New South Wales, Australia. Any disputes arising from these Terms will be resolved in the courts of New South Wales, Australia.
